List of Renunciation & Consents

These forms are renunciations and consent forms that are used in many different estate matters. If you are not certain which form would be right for your situation, please contact the surrogate's court for assistance.

1. Renunciation of Executorship

When you are named in a Will as the Executor but you do not wish to act, this form is used.

2. Renunciation of Trusteeeship

When you are named in a Will as the Trustee but you do not wish to act, this form is used.

3. Renunciation of Administration

When you are the next of kin of an estate where there is no Will (intestate) and you do not wish to act, this form is used.

4. Renunciation of Administration Ad Prosequendum

This form is used when you do not wish to act as the Administrator AdPros in order to sue a defendant in civil court for wrongfully causing the death of a decedent who died without a Will.

5. Consent for Affidavit of Next of Kin

When the estate is small, there is no Will and you are one of the heirs who wishes to have one of the other heirs handle the estate this form is used.

6. Consent for Guardianship

This form is used when you wish to consent to the appointment of another family member to be the guardian of a minor's property.

7. Renunciation for Administration C.T.A.

This form is used when you wish to renounce as next of kin or residuary legatee of an estate with a Will to appoint an Administrator CTA. This form is only used when the named executor has died or has renounced his/her right to act.

8. Renunciation for Sub-Administration

This form is used when you wish to renounce as next of kin of an intestate estate (no Will) to be appointed as Sub-Administrator This form is only used when the original Administrator qualified, acted in said capacity and then died without completing the estate business.

9. Renunciation for Sub-Administration C.T.A.

This form is used when you wish to renounce as next of kin or residuary legatee of an estate with a Will to be appointed the Sub-Administrator CTA. This form is only used when the original Administrator CTA qualified, acted in said capacity and then died without completing the estate business.

10. Co-Executor Reserving the right to Qualify

This form is used when a Co-executor wishes to reserve his/her right to qualify at a later date and allows the other named Co-executor to act as the sole executor. When using this form you must understand that when and if you wish to qualify at a later date you must take the request to the Superior Court to complete the task.

List of Miscellaneous Forms

This group of forms are used in transferring items involved in an estate. This would include forms for completing estate work along with information sheets to be filled in and mailed, or sent by facsimile transmission (732-506-5087), to the surrogate's court in order to expedite the preparation of estate papers.

1. Affidavit of Residence

This form is used when the death certificate shows the decedent's address is incorrect. The person who can sign this form must be an uninterested party to the estate. (Such as a good friend or neighbor who does not inherit from the estate)

2. Affidavit of Domicile (used for stock)

This form is used in the process of tranferring stock.

3. New Jersey Motor Vehicles Form for Surviving Spouse

This form is used to transfer an automobile that is jointly owned between husband and wife.

4. Refunding Bond & Release Form

This form is used to show that you have received your part of any estate and wish to release the Executor or Administrator from bond, if one was necessary. This form must be signed in the presence of a notary public

5. Sample of a Refunding Bond & Release Form

This sample form shows how the refunding bond and release form should be filled out.

6. Estate Information Sheet

This form is used when you plan to mail the estate information to any Surrogate's Court in New Jersey. It is to be mailed along with the Original Will (if one exists) and the Death Certificate with a raised seal.

7. Guardianship Information Sheet

This form is used when you plan to mail the minor's information to any Surrogate's Court in New Jersey.

8. Release of General Guardian

This form is to be used to release a Guardian that has been bonded.
